1. Publisher & legal notice
The Nova software and this website (the “Site”) are published by [Company name] (“the Publisher”, “we”). Contact: mailprosasha2@gmail.com.
Site hosting: Vercel Inc., 340 S Lemon Ave #4133, Walnut, CA 91789, USA. License-service hosting: Supabase, Inc. Payments: Stripe (the Publisher never has access to your card details).
2. Purpose
These terms govern the sale of subscriptions to the Nova dictation software for Windows: Nova Pro and Nova Ultra (and, where applicable, Nova Business), on a monthly or annual basis. The free version of Nova is not covered by these terms.
Placing an order constitutes full and unreserved acceptance of these terms.
3. Price and payment
Prices are shown in euros, all taxes included, on the Site's Pricing page. Payment is processed through Stripe, at subscription and then at each billing period (monthly or annual) by automatic renewal, until cancellation. Invoices and receipts are issued and sent by Stripe to the e-mail address provided at purchase.
The Publisher may change its prices; any price change is notified by e-mail at least 30 days before it applies to a renewal, and the customer may cancel before it takes effect.
4. Delivery
The license is digital content delivered immediately after payment: the license key is displayed on screen right after payment and sent to the e-mail address provided. It activates Nova on up to two (2) computers (a device inactive for 30 days automatically frees up its slot).
5. Right of withdrawal
Under French consumer law (Article L221-18 of the Code de la consommation), consumers have fourteen (14) days to withdraw from a purchase. However, by completing payment, the customer expressly requests immediate supply of the digital content; under Article L221-28 13° of the same Code, activating the license key constitutes the start of performance with the customer's express consent and express waiver of the right of withdrawal.
- Unactivated key: withdrawal remains possible within 14 days of purchase, by e-mail to mailprosasha2@gmail.com (full refund within 14 days, license invalidated).
- Activated key: the right of withdrawal is extinguished; no refund is owed on that basis.
- Renewals (monthly or annual) do not open a new right of withdrawal.
6. Cancellation
The subscription can be cancelled at any time, without justification, from the Stripe customer portal (linked in billing e-mails) or by e-mail. Cancellation takes effect at the end of the current billing period: the service remains available until that date and no prorated refund is issued for the period already begun.
7. Goodwill refunds & anti-abuse
Outside of the right of withdrawal (Section 5) and statutory warranties (Section 9), any refund is a discretionary goodwill gesture by the Publisher. To prevent abuse:
- such a goodwill gesture is limited to one (1) refund per customer per one-hundred-eighty-day (180) period — “customer” meaning the same e-mail address, the same payment method, or the same activated device;
- any refund, on whatever basis, results in the immediate deactivation of the associated license key;
- in case of manifest abuse (repeated purchase-refund cycles, unfounded payment disputes), the Publisher reserves the right to refuse any new sale and to deactivate the licenses concerned.
8. License to use
Nova is licensed, not sold. The license is personal, non-exclusive and non-transferable: sharing, reselling or renting the key is prohibited, as is decompiling or reverse-engineering outside cases permitted by law. The tiers, quotas and features of each plan are described on the Pricing page; the online engine (“Turbo”) is subject to a fair-use policy.
9. Statutory warranties
Consumer customers benefit from the statutory guarantee of conformity for digital content and services (Articles L224-25-12 et seq. of the French Code de la consommation), which applies independently of these terms. Nova is otherwise provided “as is”; the Publisher's liability, on any basis, is limited to the amount paid by the customer over the preceding twelve (12) months, excluding losses that cannot legally be excluded.
10. Governing law & mediation
These terms are governed by French law. Under Articles L612-1 et seq. of the Code de la consommation, the customer may refer the matter free of charge to a consumer mediator.
